The motives and some hypothetical consequences of turning the Judicial one into a «territorial power» are considered in the following lines, concerned by a legislative reform that, on the assumption of it were finally approved as raised, should produce a deep change in the way in which either that state Power and the Supreme Court of Spain were regulated in the Constitution of 1978.La reforma procesal instada por el Gobierno ante el Parlamento español en julio de 2005, en lo que a la modificación del tradicional régimen del recurso de casación se refiere, afecta a una serie de cuestiones que, más allá de la necesidad declarada de dar solución a un retraso �ya cada vez menor� en la resolución de esta clase de recursos por el Tribunal Supremo, trascienden a las de mero procedimiento para entrar de lleno en la configuración de uno de los poderes del Estado: el Poder Judicial.
