This is specially important concerning those european undertakings whose legality can not be controlled by the European Court of Justice. Two possible solutions have been examined: the one coming from French Law (the liability without unlawfullness) and the one derived from German Law (the cuasi-expropiatory measures over property). Here we review the judicial treatment of this question, paying special attention to the FIAMM case (2008), the last one on this topic from the European Court of Justice, that seems to open new alternatives.El Derecho comunitario reconoce y protege el derecho de propiedad privada. El Tribunal de Justicia distingue dos supuestos de intervención en el derecho: la delimitación de su contenido y la expropiación. Sin embargo, existen medidas comunitarias que atentan a la propiedad y no son reconducibles a ninguna de las dos figuras citadas. Ello plantea problemas especialmente ante medidas cuya legalidad no puede ser atacada por los órganos jurisdiccionales comunitarios. Dos posibles soluciones se han planteado: la ofrecida por el Derecho público francés (aplicación de la responsabilidad patrimonial objetiva de los poderes públicos) y la adoptada por el Derecho público alemán (las intervenciones cuasiexpropiatorias en el derecho de propiedad).
