Summary: This article deals with the question of whether the new Spanish consumer arbitration� scope of application established by Royal Decree 231/2008 of 15th February 2008 allows the defence of collective and diffuse interests of consumers. This exposition will be done, on one hand, studying the fundamental regulation that this new Royal Decree 231/2008 has introduced about the collective consumer arbitration; and, on the other hand, studying the main jurisprudence and the relevant literature on this specific question that took place when the former Royal Decree 636/1993 of 3rd May 1993 was in force; what will help us to understand the new regulation.
