Answers to these questions imply going over through an itinerary in which the origin of the principle of legality on Penal Law is stated, its presence in 1917 Codex and in the current Code in order to evaluate it in the new understanding horizons and the application of canonical penal law inside traditio canocica's furrow.El c. 1399 se sitúa en el conjunto del libro VI sobre las sanciones en la Iglesia como una norma general que permite en unas determinadas condiciones imponer una sanción no tipificada. Esta norma, ¿es una excepción o contradicción al principio de legalidad penal?, ¿qué consecuencias comporta mantener esta excepción?, ¿qué consecuencias conlleva la supresión de este canon?
