Many times we read news related to filiation through the related subrogation familiar characters. We propose, therefore, to study through various practical cases in which the court has ruled and the Directorate General of Registries and Notaries, the main conflicts arising from the registration of children born out of our country and the recognition of parenthood, from the position of the protection and best interests of the child. We intend to see the position taken by the legislation, doctrine and jurisprudence in a case marked by a law which is scheduled to change in the future.El presente trabajo analizaun tema de gran relevancia dentro del Derecho de familia, como es el caso de lagestación por sustitución y la protección del menor. En numerosas ocasiones leemos noticias relacionadas con la filiación a través de la subrogaciónrelacionadas con personajes conocidos. Nos proponemos, pues, estudiar a travésde diversos supuestos prácticos en los que se ha pronunciado los tribunales,así como la Dirección General de los Registros y del Notariado, los principalesconflictos surgidos por la inscripción de los nacidos fuera de nuestro país yel reconocimiento de la filiación, desde la postura de la protección e interéssuperior del menor.
