Specifically, we analyze the STC of the First Chamber of December 22, 2008 and the judgment of the Court of Justice of Galicia of May 25, 2011. Trying different aspects both in the problems that the development of this law entails.El presente artículo analiza el derecho del menor extranjero no acompañado a poder ser representado ante un procedimiento tanto administrativo como civil por un abogado independiente que vele por sus derechos e intereses en el procedimiento judicial de que se trate. Derecho que le permitirá a ser informado, oído y mostrarse parte ya sea por la mera proposición de pruebas y por tanto a defenderse de las decisiones adoptadas que puedan suponer una vulneración de sus derechos.Concretamente se analizarán las STC de la Sala Primera de 22 de Diciembre del 2008 y la Sentencia del Tribunal Superior de Justicia de Galicia de 25 de mayo del 2011.
