Under the expression “Polycontexturality”, as a criterium to investigate the sense fragmentarion in post modernity, thereis a possible and interesting analysis of the Transnational Legal Pluralism. Following the “irritations” caused by ecological risks in our Society is the “Environmental State” which means a new function to the State, as a political organization with the scope to maintain itself as a privileged social actor. Thus, the new rights are the place where the Polycontextural Observation and the State organizational operation are redefining the complexity over the relations between Law and Politics, under the sight of Reflexive Right.O presente trabalho apresenta uma descrição acerca das interfaces e acoplamentos havidos entre o Direito e a Política na Sociedade Contemporânea. Diante da noção de “Policontexturalidade”, como critério de investigação da fragmentação do sentido na pós-modernidade, tem-se a possibilidade de confecção de uma interessante análise do Pluralismo Jurídico Transnacional. Acompanhando as “irritações” emanadas dos riscos ambientais produzidos pelaSociedade atual, está o “Estado Ambiental” que é um redirecionamento da função do Estado como organização política visando a abordagem de seus limites e invenções para a sua manutenção como Ator Social privilegiado.
