The reached results target a citizenship restricted concept accept in Brazil Imperial period, which excluded Indians and Negroes from Habeas Corpus and the women had a little access to it. The methodology approached was theoretical and historical theory, with specific bibliography.Este artigo objetiva examinar a inserção do Habeas Corpus no Brasil, em 1832, no Código de Procedimento Criminal, em meio à estrutura monárquica e agrária do Império. O estudo perpassará além das codificações penais, as Ordenações Filipinas e a Constituição do Império, enfocando o suporte jurídico da garantia de liberdade física individual, tendo como pano de fundo o escravismo e o patriarcalismo, ligados à dominação agrária, a par do liberalismo da burocracia estatal. Os resultados alcançados apontam para o estreito conceito de cidadania recepcionado no Brasil Império, que excluía negros escravos e índios e restringia para as mulheres o acesso à tutela jurídica do Habeas Corpus.
