The authors approach the particularnature of the State’s international responsibility on this subject, the scope of the State’sresponsibility regarding vulnerable populations within the penitentiary establishments, as wellas the demands made to the State in order to adapt the penitentiary system in general, inorder to guarantee the inmate’s human rights.No presente texto os autores se aproximam às normas do Sistema Internacional dosDireitos Humanos, em especial o Sistema Interamericano de Direitos Humanos (emdiante o “SIDH”), em relação com o dever de custodia frente às pessoas privadas da liberdade. Desta maneira, se aproximam à natureza particular da responsabilidadeinternacional do Estado na matéria, ao alcance das obrigações estatais em quanto adeterminadas populações vulneráveis dentro de centros carcerários e penitenciários,assim como as exigências feitas ao Estado de adequar o sistema carcerário em geral,com o fim de garantir os direitos dos internos.En el presente texto, los autores se aproximan a los estándares del Sistema Internacional de los Derechos Humanos, en especial el Sistema Interamericano de Derechos Humanos (en adelante el “sidh”), en relación con el deber de custodia frente a las personas privadas de la libertad.
