This article discusses the problematic and evading development of conscientiousobjection in the context of the Colombian constitutional jurisprudence. From a historical allusion to the famous case of the “Mayflower Pilgrims” –which serve as areference to the central problems that faces the objector–, it seeks to define the scopeof conscientious objection as a fundamental right (as a fundamental justice claim)in regard to the “factual” and “legal” possibilities for its exercise, for which there willbe a brief contrast between the most representative cases decided by the ColombianConstitutional Court in such matter. The core of the article is the idea that thereis an ideological prevalence that, unjustifiably, makes it difficult and in some casesdenies the exercise of the right to object in consciousness, particularly when it comes tothe right of life in regard to the abortion case.

A partir deuma alusão histórica ao famoso caso dos “Peregrinos do Mayflower”, que serviráde referência aos problemas centrais que enfrenta o objetante, se procura delimitaro âmbito da objeção de consciência como direito fundamental (como pretensão dejustiça iusfundamental) em razão das possibilidades “fáticas” e “jurídicas” para se exercício, para o qual se fará um sumário contraste entre os mais representativos casos,sentenciados pela Corte Constitucional Colombiana. O núcleo do artigo o constitui aidéia de que existe uma prevalência ideológica que, injustificadamente, faz difícil eem alguns casos insidioso o exercício do direito a objetar em consciência, particularmentequando se trata do direito à vida no denominado caso do aborto.En este artículo, se aborda el problemático y zigzagueante desarrollo de la objeción de conciencia en el marco de la jurisprudencia constitucional colombiana. A partir de una alusión histórica al famoso caso de los “Peregrinos del Mayflower”, que servirá de referencia a los problemas centrales que enfrenta el objetor, se busca delimitar el ámbito de la objeción de conciencia como derecho fundamental (como pretensión de justicia iusfundamental) en razón de las posibilidades “fácticas” y “jurídicas” para su ejercicio, para lo cual se hará un sumario contraste entre los más representativos casos fallados por la Corte Constitucional Colombiana.
