The text explores the ways in wich the indigenous people used the law during the laststage of the colonial era, it means, since the Bourbon reforms to the independence.The first part of the text is the result of an historiographical review, that shows theway in which the original ideal of the colonial regime of conserving the indigenouslegal systems was transformed into the creation of a distinctive legal system thatpretended to separate the “republic of indians” from the “republic of spaniards”. Theseparation was not effective in order to preserve the pre hispanic legal traditions,but it allowed the different ways in which the law was used as a mecanism for adaptionand resistance. The second part of the article describes those uses of law, withsome legal actions by the indigeous people in the end of the xviii century and thebeggining of the xix in the New Kingdom of Granada.

A primeira parte, resultado de uma revisão historiográfica,dá conta de como a inicial pretensão do regime colonial de conservar ossistemas jurídicos indígenas, derivou na criação de um regime jurídico diferenciado,que separava a “república de índios” da “república de espanhóis”; separação que, sebem não foi efetiva em preservar as tradições legais pré-hispânicas, permitiu diversosusos do Direito como mecanismo de adaptação e resistência. A segunda parte do textoilustra estes usos do Direito, com algumas atuações jurídicas de indígenas no fimdo século XVIII e princípios do XIX no Novo Reino de Granada.El artículo explora los usos que del derecho colonial hicieron los indígenas en la última etapa de este período de la dominación española, que va desde las reformas borbónicas hasta la Independencia (1750-1810). La primera parte, resultado de una revisión historiográfica, da cuenta de cómo la inicial pretensión del régimen colonial de conservar los sistemas jurídicos indígenas derivó en la creación de un régimen jurídico diferenciado, que separaba la “república de indios” de la “república de españoles”; separación que, si bien no fue efectiva en preservar las tradiciones legales prehispánicas, permitió diversos usos del Derecho como mecanismo de adaptación y resistencia.
