With the repeated delay in the examination and award of marks by the PTO, plus all the relevant deadlines for countries of comparable economy to Brazil - a fact that is incompatible with the State of Direct - the relevance of this study is obvious.Le but de cette étude est la protection des marques non enregistrées au Brésil. Contrairement à ce que beaucoup de doctrine et de jurisprudence certaine demande en justice n'est pas vrai que la marque non enregistrée est dépourvue de protection en vertu de la loi brésilienne. Se produit seulement que la protection de la marque est diverse, et plus étendus que ceux qui n'ont pas enregistré. Avec le retard répété dans l'examen et l'attribution des notes par la prise de force, ainsi que tous les délais pertinents pour les pays d'économie comparable au Brésil - un fait qui est incompatible avec l'Etat de direct - la pertinence de cette étude est évidente.A questão deste estudo é a proteção da marca não registrada no Brasil. Ao contrário do que muita doutrina e certos precedentes judiciais afirmam, não é verdade que a marca não registrada seja desprovida de proteção no direito brasileiro. Ocorre, apenas, que as marcas registradas tem proteção diversa, e mais extensa, do que as não registradas.
