Summary: The aim of this article is to analyze the debates surrounding the right to strike in the National Constituent Assembly of 1933-34, in which the political implications of the strike itself were disputed during the deadlock between the state and workers before society. It is in this context that the article seeks to analyze the arguments presented to the assembly, including how they were delivered and by whom, in debating the significance of the constitutionalization of such a right. The article aims to verify the hypothesis of the upholding of the right to strike as a right previously recognized by the Brazilian legal system, which, in the workers' eyes, merely required constitutional approval so as not to be even more violently opposed by the police. The work also thus seeks to understand the dynamics of the inclusion/exclusion of the right to strike from the 1934 Constitution, through the various profiles of the actors involved, the interests represented, the speeches given in the assembly and an analysis of the political-juridical context. Sources used include the proceedings of the 1933-34 assembly, its preliminary drafts, the final copy, as well as pertinent newspapers, books and dictionaries from the same period in which the research was undertaken.
