In the present research we will be limited to the legal problems of administrative silence in its positive and negative manifestations. At present, the European, Latin American and American Public Administration has not met the expectations of efficiency, speed, economy, transparency, due process, reasonable time as other guiding principles which project a proper development, fair and expeditious administration and its communicating means: administrative acts. The scope of the topic, propose a tentative legal nature of administrative silence, its administrative and procedural treatment and legal controls to which is subject, reflecting on the necessary control of the generated administrative acts based on administrative silence positive or negative.El problema de la inactividad administrativa constituye un divorcio entre el Administrado y la administración; llevando consigo la administración una posición de garante de la legalidad y un deber funcional por parte de los funcionarios y servidores. El presente trabajo de investigación se circunscribe a la problemática jurídica del silencio administrativo en sus manifestaciones positiva y negativa. En la actualidad, la Administración Pública Europea, Latinoamericana y Americana no ha cumplido con las expectativas de eficiencia, celeridad, economía, transparencia, debido procedimiento, plazo razonable, entre otros principios rectores que proyecten un desenvolvimiento adecuado, justo y expeditivo de la administración y sus medios comunicantes, los actos administrativos.
