The sentence in commentary refers to the acquisition of
territories, one of the classical issues of International Law, and the
maritime delimitation of the exclusive economic zone and the continental
shelf regarding the territorial and maritime dispute between
Nicaragua and Colombia in the Caribbean Sea. The commentary
deals with two of the three subjects of the sentence, which are, the
islands and low-tide elevations, their legal definition, the possibility
of appropriation of the islands and cays, the territorial rights that
they generate in the determination of the territorial sea, the continental
shelf and the exclusive economic zone, and the examination
of territorial titles, specially, based on the principle of uti possidetis
juris and the adjudication. Finally it is analyzed the significance of
the jurisprudence taking into account its application in the decision. |
