The UK has achieved this challenge, an outstanding result, in 1998 enacting a bill of rights that expresses the rights and liberties of the people of Britain.¿Cuáles son los caracteres que defi nen a un diseño constitucional orientado a la protección y fortalecimiento de derechos, como tal? La respuesta a esta pregunta nos enfrenta al desafío de intentar equilibrar la relación entre democracia y derechos, entre la primacía del parlamento como expresión de la voluntad popular de ciudadanos libres e iguales y el reconocimiento de ciertos derechos básicos de los que somos titulares por nuestra sola condición humana y ante los cuales los gobiernos deben someterse.
