La disputa entre Democracia y Derechos: El caso de la "Human Rights Act" británica
Summary: Which are the characteristics that defi ne a constitutional design oriented to rights protection and reinforcement? The answer to this question confronts us to the challenge of trying to balance the relationship between democracy and rights, including the primacy of parliament as an expression of the popular will of free and equal citizens and the recognition of certain basic rights that we own because of our human condition and due to which governments must submit. The UK has achieved this challenge, an outstanding result, in 1998 enacting a bill of rights that expresses the rights and liberties of the people of Britain.
