Summary: This article has the purpose to establish the importance of landscapeto set the legal status of a new citizen´ms right, through the creation of a regulatory framework that recognizes and protects the landscape as a key factor in the quality of life of citizens, their cultural, socioeconomic development and their physical and spiritual well-being. The article begins with a description of different notions of landscape, afterwards with the analysis of main initiatives and international conventions that have established strategies and actions to protect landscapes as cultural and natural heritage of mankind; Subsequently, it is analysed the national legal system, as well as the legal frame of the State of Baja California and the municipality of Mexicali, related to the conservation of the historic heritage and landscape. Finally, the paper concludes with an assessment and a proposal concerning the need to develop a legal regulation for the protection, planning and management of landscapes.
