Summary: |
This article seeks to expose a theoretical framework addressing the indigenous justice from the
point of view of legal pluralism. This framework recognizes the indigenous justice as a model
for normative integration, which has been used in these kinds of communities for thousands
of years. The indigenous practices seen from their own perspective and cosmogony, show a
passionate, versatile, and at many times creative and effective structure for protecting their
rights, those of their community, and those of their great nation. Some concepts will alter
some interesting situations that will be used as logical and theoretical framework in order to
understand the uses and habits of the "Pastas" indigenous community, located in the south of
Colombia, their structure and organization system, their oral juridical system but, above all, the
indigenous existence and resistance, identity and intercultural forms, which have allowed the
parallel, simultaneous or alternative coexistence of two ways of coexistent infra state rights. |
