Summary: The present study sought to answer the following problem: What are the real effects of default with respect to the evidence by defendants revel? The overall goal of the research is guided in discourse can be the judge, just under the argument that took place in absentia, despising the evidence that might revel present. The specific objectives consisted in demonstrating the necessity of evidence in rational persuasion of the magistrate; warn about the alleged presumption of truthfulness arising from default; talk about the principle of free conviction motivated the judge and analyze the effects and cases in which the default occurs. This work was performed by means of a theoretical research, which targeted a survey of bibliographic data on the subject.
