Accordingly, based on the analysis of current doctrinal who argue that the celebration of the environmental term of adjustment of conduct can generate penal consequences, will be seek a alternative to the problem focused.Este estudio se basa en la necesidad de consolidar la eficacia del compromiso de ajuste de conducta ambiental, dando por sentado el hecho de que la falta de vinculación entre las diferentes esferas de la responsabilidad ha supuesto un obstáculo para la firma de nuevos compromisos y para el debido cumplimiento de los ajustes ya concluidos. En consecuencia, a partir del análisis de las corrientes doctrinales que argumentan que la celebración del compromiso de ajuste de conducta ambiental puede generar consecuencias penales, se buscará una alternativa al problema enfocado.O presente estudo baseia-se na necessidade de consolidação da efetividade do termo de ajustamento de conduta ambiental, adotando como pressuposto o fato de que a ausência de vinculação entre as diferentes esferas de responsabilização tem implicado em um óbice para a assinatura de novos termos e para o adimplemento dos ajustes já celebrados.
