This article, besides demonstrating that the environment ecologically
balanced is a fundamental Right (belonging to the third
dimension of Human Rights), aims at analyzing the responsibility
of the present generations about the possibility of a healthy and
comely life for future generations. We propose an analysis of the
concept of environment as well as of the receivers of the Constitutional
Environment Rules (according to art. 225, caput of the Constitution from 1988). It goes on with the analysis of the principle
of the human dignity and its environmental perspective. So,
we realize the importance of protecting and promoting an ecologically
and balanced environment with the responsibility of the
present generations about the comely life of the future ones. |
