Summary: By providing historical context, this study seeks to demonstrate the evolution of the legal concept of contracts and the implications for the comprehension of this legal phenomenon, in light of a new order of ideas. The theme was divided into two large items to facilitate understanding of the topic for the readers: one item was reserved for the study of classic contract theory and the other for modern contract theory. In this context, we see a notable interest in harmonizing the alterations that the legal concept of contract underwent, with the transformations imposed by the succession of State paradigms. The objective of this study was to demonstrate, while always maintaining a leading posture, the significant change observed in the understanding of contractual dynamics, with one of its main beacons being the relation between State actions and private and individual interests.
