Summary: Aware of the importance and the human value that the right to personal integrity has in the world today, and that torture, like cruel, inhuman or degrading punishments or treatment have been described as �a 20th century plague, in one of the most cruel expressions of a set of unresolved conflicts in our societies,�1 we have sought in this article to present the concept and legal basis for this extremely important right. We approached the issue from the point of view of both national and international law, and then analyzed the case of Wilson Gutiérrez Soler against the State of Colombia, in which it is possible to see how difficult and traumatic it is for the victims of violations of the right to personal integrity to return to their personal, family and social habitat, and above all, to emphasize the way that this right must be effectively protected on an international level.
