Summary: Articles 17 and 23.8 of the Spanish Law 4/2012 are conflict of law rules, which need to be interpreted in order to establish their scope. Article 17 is a transposition of article 12 of Directive 2008/122 and should only be applied when the rules of the Spanish Law resulting directly from the Directive are concerned. Article 23.8 is not the result of transposition and it is a rule through which Spanish legislator tries to unilaterally modify Regulation Rome I.
