With the arrival of the new millennium, Argentina began modifying legislation related to
migration and refugees. It was in this context that Immigration Law no. 25871 was
enacted in 2003, and the General Law for the Recognition and Protection of Refugees
no. 26165 was approved in 2006. In this article, we propose to investigate the relation
between migration policies and refugee policies in Argentina based on the changes in
both sets of legislation. We thus analyse the previously mentioned policies, as well as the
statistics compiled by the National Refugee Commission and the National Immigration
Directorate which establish a wider framework for the problem.

Dans ce contexte, en 2003, la Loi sur l'immigration n° 25871 a été promulguée. Puis en 2006, la Loi générale sur la reconnaissance et la protection des réfugiés n º 26165 a été votée. Dans cet article, nous nous proposons d'étudier le rapport entre les politiques de migration et les politiques d'asile en Argentine à partir des changements intervenus dans ces deux lois. À cette fin, nous analyserons les textes de loi susmentionnés, ainsi que les statistiques compilées par la Commission nationale pour les réfugiés et la Direction nationale de l'immigration, qui nous permettront d'établir un cadre plus ample à ce problème.Com a chegada do novo milênio, a República Argentina começou a modificar a legislação relacionada com a migração e o refúgio. Neste contexto, no ano de 2003 foi promulgada a Lei de Imigração n° 25871. Enquanto isso, em 2006, foi aprovada a Lei Geral de Reconhecimento e Proteção de Refugiados n º 26165. Neste artigo propomos investigar a relação entre as políticas de migração e as políticas de refúgio na Argentina a partir das mudanças em ambas as normas. Para isto, são analisadas as políticas previamente mencionadas, bem como as estatísticas compiladas pela Comissão Nacional para os Refugiados e pela Direcção Nacional de Imigração que estabelecem um quadro mais amplo deste problema.Con la llegada del nuevo milenio la República Argentina comenzó a modificar la legislación relacionada con la migración y el refugio. En este contexto en el año 2003 se sancionó la Ley Migratoria N° 25871. Por su parte en el año 2006 fue sancionada la Ley General de Reconocimiento y Protección al Refugiado N° 26165. En este artículo nos proponemos indagar la vinculación entre las políticas migratorias y las políticas de refugio en Argentina a partir de las modificaciones en ambas normativas. Para ello, se analizaran las políticas previamente mencionadas, así como también las estadísticas elaboradas por la Comisión Nacional para los Refugiados y la Dirección Nacional de Migraciones que permiten establecer un panorama más amplio de esta problemática.Instituto de Ciências Humanas e Filosofia.
