In this article, the author argues that the determining factor to qualify a system of
inquisitorial procedure or adversarial has no relation with the political regime in that system
develops. By contrast, the main element to qualificate the system is only the role of the
judge in the instruction of evidence, independent issue of the political overview of the state
in which the system operates. Always connected to the above, the author notes the overview
of the Chilean procedural law, regarding the role of the judge at the evidentiary instruction. |
