The compatibility with an action of damages will depend, logically, of the separation that can become in the economic compensation of the fault as attribution factor, and in addition, of the correct boundary of what the compensation tries to repay. In the following lines, we will review some of the diverse postulates through which the national doctrine tries to explain the foundation of the economic compensation and, in addition, a proposal is suggested.Establecer cuál es la naturaleza jurídica y el fundamento de la compensación económica nos permite no solo determinar si es posible aplicar un régimen jurídico en forma supletoria, sino además establecer si la compensación es compatible con otras prestaciones económicas, y en particular, con una acción de daños derivados del divorcio o de los hechos que le han dado lugar. La compatibilidad con una acción de daños dependerá, lógicamente, de la desvinculación que pueda hacerse en la compensación de la culpa como factor de atribución, y además, de la correcta delimitación de aquello que la compensación pretende resarcir.
