Created by the Government (Administrative and Legislative) may experience problems that displease their recipients (population), resulting in the possibility of being examined by the judiciary, since they regularly provoked. This analysis will result in a judicial decision, which must follow strict patterns of interpretation and reasoning, analyzing each case. In this paper, we show in this article the methods of interpretation and reasoning of judicial decisions for the control of public policies, from various theoretical concepts to a model examples of practical application, the application was chosen for the case of proportionality, with its due adequacy.As políticas públicas são importante meio de concretização dos direitos fundamentais na sociedade. Criadas pelo Poder Público (Administrativo e Legislativo) podem sofrer problemas que desagradem seus destinatários (população), surgindo a possibilidade de serem analisadas pelo Poder Judiciário, desde que regularmente provocado. Tal análise resultará em uma decisão judicial, que deverá seguir moldes rigorosos de interpretação e fundamentação, analisando cada caso concreto.
