Lack of this classification could result in the International Criminal Court to execute its competence based on the principle of complementarity, specifically for the material incapacity of the Colombian State to carry out a criminal prosecution of a person responsible for a crime against humanity.Este artículo de investigación tiene como propósito analizar las consecuencias que genera la ausencia de tipificación de los crímenes de lesa humanidad en Colombia. Así las cosas, una de las consecuencias que ha generado dicha ausencia de consagración penal es el desconocimiento del principio de legalidad, debido a la posibilidad que tienen las autoridades judiciales de aplicar, directamente, el Estatuto de Roma para calificar una conducta como constitutiva de un crimen de lesa humanidad.
