Different types of discrmination contained in the Directives in force at the material time (Article 13 of
the Agreement of the European Community): Council Directive 2000/43/EC of 29 June 2000,
implementing the principle of equal treatment between persons irrespective of racial or ethnic origin;
Council Directive 2000/78/EC of 27 November 2000, establishing a general framework for equal
treatment in employment and occupation and Council Directiveof 13 December 2004, implementing
the principle of equal treatment between women and men in the access to and supply of goods and
services. Direct or indirect discriminatory treatment for ethnic reasons. Circumstances of the case
judged by the Third Section of the European Court of Human Rights, in the procedure originated in
the application (no. 49151/07) against the Kingdom of Spain, lodged by a member of Rome
Community of Spanish nacionality, who complained about the refusal from the Spanish Constitutional
Court to grant a survivor´s pension, on the sole ground that she was not married under Spanish Law.
