We performed a thorough and comprehensive analysis of the normative regulations specific preventive guardianship Argentine law, the author intended to demonstrate the benefits of its application. Finally, the author intends to build, citing doctrinal and autonomous development, a procedural step from the filing of the application, with special reference to the standing upon, through the preliminary stages, and ending with the sentence, its effects and sentencing in coastline.Se analiza la tutela judicial preventiva desde la perspectiva argentina, indicando los fundamentos normativos, las posturas doctrinarias y algunos casos jurisprudenciales. El autor realiza críticas, reflexiones, propuestas y ejemplificaciones. También se valora la utilidad práctica de la acción preventiva y del mandato preventivo así como debe ver el juez, en los tiempos actuales, el proceso ante la necesidad de prevenir los daños. Se realiza un exhaustivo y completo análisis de las regulaciones normativas específicas de tutelas preventivas en el Derecho Argentino, pretendiendo demostrar el autor los beneficios de su aplicación.
