The right to the free development of one�s personality as embodied in Article 16 of the Colombian
Constitution states that this should be enjoyed by
all people without distinction. However, exercising
this right cannot be absolute as it may be limited by
the rule of law itself. Educational institutions� coexistence manuals have often arbitrarily sought to
ignore (rather than limit) this right, especially regarding students� hair styles and haircutting (i.e.
length). The constitutional court has handed down
multiple rulings (especially when reviewing lawsuits) to protect this right, or overturn it, regarding
hair styles and haircutting in infant, primary, secondary and vocational educational facilities, thereby establishing a jurisprudential line and forming
the topic outlined and analysed in this article

Contudo, o exercício deste direito não é absoluto e pode ser limitado dentro dos próprios parâmetros do Estado Social de Direito. As Instituições Educativas, por meio dos seus manuais de convivência, têm procurado desconhecer (mais que limitar) de alguma maneira - muitas vezes arbitrária - este direito, especialmente quanto ao corte e forma do cabelo dos estudantes. O Tribunal Constitucional proferiu já uma grande multiplicidade de sentenças (especialmente ao rever acções de tutela) protegendo ou não este direito pela ocorrência de estes fatos jurídicos em estabelecimentos de educação básica primária, secundária e média vocacional, estabelecendo uma linha jurispr udencial, a qual se esboça e analisa no presente artigo.El derecho al libre desarrollo de la personalidad consagrado en el artículo 16 de la Constitución Política y del cual gozan todas las personas sin distinción alguna por poseer esta condición. Sin embargo, el ejercicio de este derecho no es absoluto y puede ser limitado dentro de los parámetros mismos del Estado Social de Derecho. Las instituciones educativas, por medio de sus manuales de convivencia, han buscado desconocer (más que limitar) de alguna manera �muchas veces arbitraria� este derecho, especialmente en cuanto al corte y forma del cabello de los estudiantes.
