Summary: This article aims to analyze the Draft Law on Mediation in Civil and Commercial Matters, which is intended to incorporate into our legal order the Directive 2008/52/CE. The study focuses on how the Spanish legislator has dealt with some relevant issues such as the principles governing mediation, its scope of application, the role of the mediator, the procedure to be followed or the effectiveness and enforceability of the agreements reached therein.
