These principles were fundamental in influencing the organization of the new Hispanic American States at the beginning of XIX century.En este estudio se analizan los principios fundamentales del constitucionalismo moderno que se conformaron como resultado de la Revolución Francesa de 1789, que fueron: la idea de la Constitución para la organización del Estado y como emanación de la voluntad popular; la declaración en ella de los derechos del hombre; la asunción de la soberanía por el pueblo; el principio de la representación para su ejercicio; el principio de la separación de poderes para la organización del Estado; la supremacía de la ley y el principio de legalidad; y la distribución territorial del poder y el municipalismo.
