The article presents an analyse about the role of the state in the relationships between the
native communities and the hydroelectrical projects in Colombia, as well as the juridical
considerations implied in these situations, taking as study case the construction of the Urrá
dam in the High Sinú region, which has had a significative impact over the cultural survival
conditions of one community of the Embera-Katío people who inhabits in the territories
