Summary: The following article is a product of the research called �Influence the international instruments from the International Criminal Law in the principle of legality in the criminal matter in Colombia�, the aim is: to analyze one of the first consequences that are shown in the adoption of the Rome statute from 1998 for the International criminal court and its relevant meaning, and their fundamental rules, such as the principle of ne bis in ídem and its relation with de principle of legality, and its effects in the criminal matter in Colombia. In fact we can see some important consequences, in the material ne bis in idem, that analyse, the concept in front of the specific elements of crime and their possible responsibility in the internal laws, and the concept of the procedure ne bis in idem and its relative concept in our legislation, that permit all of the effects of the Rome Statute in our legislation.
