It also analyses issues as public interest vs. private interest and equity on the regulations.Este artículo constituye un análisis sobre la regulación legal latinoamericana de la protección de los datos de prueba y el carácter especial que tiene esta nueva categoría de propiedad intelectual. Para ello, se estudia el artículo 39.3 del ADPIC (Acuerdo sobre los Derechos de Propiedad Intelectual relacionados con el Comercio), se analiza la situación jurídica de la propiedad intelectual de datos de prueba en países latinoamericanos y la posición de la industria agroquímica frente a estas regulaciones.
