This article analyzes whether or not the current public utilities rates regulations have a
favorable effect on the compliance of the progressivity clause of the Economic Social
and Cultural Rights (ESCR) and its legal consequences thereof. The methodological
approach is based on the interpretation of the legal obligations derived from the
International Human Rights Law in relation to ESCR and in accordance with the economic
arguments that dictate public policies, as well as the interpretation of the economic rights
provisions within International Human Rights. Under this argument, it is explained
why the States Parties of the International Covenant on Economic, Social and Cultural
Rights are legally obliged to ensure the growth of public utilities infrastructure and how
the International Law of Human Rights recognizes the limitation of state resources. The
article also analyses the principles of the Colombian public services rates regulations
and how these were useful to overcome the �bad services trap�. Finally, the article
explains why favorable results of the rates regulation result in the application of
the �progressivity clause�� in eventual amendments, and the implications of such
