Summary: This article describes the new Spanish regime of Competition Law (Law 15/2007, july 3rd.), the most important aspects of the reform and the adaptation process of the Spanish law to the EU regulation. Thus, the first subject to be boarded is the new legal system of the exceptions as a form to value the restrictive agreements followed by the regulation on the private application of the antitrust law. Next, and inside this theoretical and descriptive framework locate the vertical restrictive agreements and among them the exclusiveness clauses whose economic and legal function are relevant in respect of the distributing commercial contracts. From these considerations a new system to value the exclusiveness pacts rises, to be more accord with its nature and off course with the function of antitrust law.
