Summary: This document contains a constructive critique of Decision C � 537 of the Colombian Constitutional Court. It deals particularly with the arguments used by the Court to declare the conditional constituonality of Art. 24 of Law 1340/2009. The commentary is structured departing from the study of the principal subjects dealt with in the Decision: firstly, it deals with the "model" or "system" for the aplication of the free competition regulations currelty in force in Colombia and, secondly, it studies the value of the administrative precedent and its regulation through the so-called "probable doctrine".
