The subject concursal with the crime of swindling has generated judicial resolutions with criteria very diverse.En Costa Rica, el ejercicio ilegal de una profesión y de forma específica de la abogacía, mantiene vigencia. La jurisprudencia nacional, así como la doctrina no tienen un criterio uniforme en cuanto a si la conducta descrita en el tipo penal debe llevarse a cabo de manera habitual. Existen diferentes posiciones en cuanto al bien jurídico tutelado en este delito. El tema concursal con el delito de estafa ha generado resoluciones judiciales con criterios muy diversos.Universidad de Costa Rica.
