This paper presents an analysis of the process of institution and development of a
European Constitutional Law of the judicial power/order. To this end, the author
develops a systematic analysis of the protection of fundamental rights from a
multilevel and comparative perspective. The objects of this study are the following
sources: the European Constitutional Law, after the modifications of the Treaty of
Lisbon, that includes the Charter of Fundamental Rights in the European Union
(CFREU) and states the adhesion to the European Convention for the Protection of
Human Rights and Fundamental Freedoms (ECHR), the conventional-international
Law, with special attention to the ECHR, the national declinations of this constitutionalism
and the constitutional traditions of the peoples of Europe, that, through
the jurisprudential reformulation of the European Union Court of Justice, have assumed
the value of general principles of Law. The purpose is to contribute to the
institution of a European Constitutional Law of the judicial power/order concerning
the general principles of this, a fair trial and thus of a real European system of protection
of fundamental rights.

Con tal fin, el autor desarrolla un análisis sistemático desde una perspectiva multinivel y comparativa de protección de los derechos fundamentales. Objeto de tal estudio son las siguientes fuentes: el Derecho constitucional comunitario tras las modificaciones aportadas por el Tratado de Lisboa, que incorpora la Carta de los Derechos Fundamentales de la Unión Europea (CDFUE) y establece la adhesión de la UE al Convenio Europeo para la protección de los Derechos Humanos y las Libertades Fundamentales (CEDH), el Derecho convencional-internacional, con una atención especial al CEDH, las derivaciones nacionales de tal constitucionalismo y las tradiciones constitucionales comunes a los Estados miembros, que en virtud de la reformulación jurisprudencial realizada por el TJUE, han adquirido el valor de principios generales del Derecho.
