Summary: Scientific discussion about the effects of globalization on the theoretical base of the Constitutional Modern State and on the traditional concept of sovereignty. A general overview of the mutations suffered by the Constitutional Modern State and its current crisis with obliteration of the concept of rights protected by sovereign constitutions since the breakdown of paradigms because of the liberal capitalist reality imposed to the world after the East European communism collapse. The article also gives an overview of the possibility to surmount the Constitutional Modern State.
