The high migration flow phenomenon has existed since early in human history, but due to the globalization process it has gained a preponderant role that makes it a core topic when designing, redesigning and formulating public State politics. This article is an approach to the migrant�s socio-juridical position, and tackles several topics such as a description of the historical process where it has been developed, a recount about the international instruments that protect this position and the perspective of the global politics in migratory terms; elements that make it possible to present a diagnosis about the role that foreigners play in a globalized world.Existe un nuevo tema dentro de las agendas políticas de los Estados y son las migraciones. El fenómeno de los altos flujos migratorios ha existido desde tiempos más remotos de la historia de la humanidad. Debido a la presencia del proceso globalizador ha ido tomando mayor fuerza convirtiéndose en uno de los puntos centrales para poder diseñar, rediseñar y formular políticas públicas estatales. Este artículo presenta un primer acercamiento a la condición socio-jurídica del migrante. Aborda varios tópicos en su tratamiento desde la descripción del proceso histórico en que se ha desarrollado, pasando por un recuento sobre los instrumentos internacionales que lo protege, hasta abordar a manera de inquietud las perspectivas de la política global en materia migratoria.
