In this article both paradigms and consequences resulting for the criminal trial will be developed, with the purpose of finding which one offers a better warranty and efficiency for society.La actual reforma del proceso penal en Latinoamérica vive el tránsito del paradigma del Estado racional que, al ejercer la justicia punitiva, dota de sentido al proceso penal, otorgándole más facultades al juez, pasa al paradigma del sistema de justicia penal como marco de discusión y gestión de un conflicto de intereses surgido a consecuencia de la comisión de un delito, donde las partes, como interesados en que se resuelva, comparten protagonismo con el juzgador.
