Summary: |
The executive process is one of the legal processes
included in the Code of Civil Procedure. This process
tries to achieve the compulsory compliance via
legal of a clear, express and liable obligation. While
it is a legal institution, necessary to implement justice
in society, sometimes this tool has been reduced to
a simple drawing mechanism of money obligation,
disassociating the purpose of legal processes. So, it is
necessary to review the use of the executive process
as a legal process making room to apply the Human
Dignity Principle. |
