Nevertheless, in moments of global economic and security crisis the federal government tends to centralize power. In this context, I study in this article what is competitive federalism, and I seek to answer the question: which competitive elements survive the centralization of power. With these concepts I analyze the local legal framework in Spain. I conclude that only with the inclusion of competitive elements it is possible to equilibrate the power among the State, the regions, and the local governments.La propuesta teórica del federalismo competitivo se realiza en Estados Unidos a finales del siglo XX. Ésta sugería devolver competencias a los gobiernos regionales y locales con las cuales tuvieran mayor libertad para tomar decisiones, formular políticas públicas e innovar en la solución de problemas públicos. Con ello, se les brindaría herramientas para poder competir entre sí en una economía globalizada. No obstante, en momentos de dificultades económicas y de seguridad, el gobierno federal tiende a centralizar el poder para dar soluciones uniformes a estas problemáticas. En este contexto, el presente artículo se propone determinar en qué consiste el federalismo competitivo, y responde al interrogante sobre qué elementos de la competencia sobrevive la actual centralización del poder. A la luz de dichos conceptos se describen los rasgos competitivos que presenta el actual régimen local español.
