This essay analyzes the situation and concludes that exist some areas of the private international law, where is major efficacy in the international har monization bydetermined private actors in front of the intergovernmental agencies such as the United Nations.Los procesos de armonización internacional del derecho privado, y en especial de las cartas de crédito y cartas Standby, generan un interesante campo de reflexión acerca del papel del Estado frente a otros actores que han venido incrementando su protagonismo. Sobre el régimen internacional de las cartas Standby, existen dos tendencias: una de carácter interestatal, liderada por las Naciones Unidas a través de la CNUDMI, y otra de carácter privado, donde se destaca la labor de la Cámara de Comercio Internacional y el Instituto de Derecho y Prácticas Bancarias Internacionales.
