Sumario: This paper refers to the difficulties in achieving legal recognition of the concept of International Environmental Crime �ecological harms caused to the environment, intentionally or by guilty negligence� since the first proposals of the UN in the 40s, when international law seemed to be aware of the need to protect the environment, to the present. A process that has lost the opportunity for these crimes to be prosecuted by the ICC. For that reason, lacking international conventions, it is important to emphasize the importance of custom and general principles of law.
